Question:
The following message was received by the program from the listener (A. S. B. N). Our brother says: I am sending you this message containing my problem, which is that I committed the act with my wife during the day in Ramadan three times in three days of that month, about six years ago. I have repented for that act. I used to think that the expiation for it was only feeding people, and so I neglected it for several years, thinking that it was permissible for me to feed them whenever I wished. Recently, I learned the truth about the expiation. What is your opinion, may Allah reward you with good? Is it permissible for me to feed ten poor people for each day, or what? Is there also an expiation for my wife? Is there a difference between her being coerced or not? May Allah reward you with good?

Answer:
It is obligatory for both of you to repent, seek forgiveness, and feel remorse for what happened, because Allah has forbidden the fasting person from consuming things that break the fast, and the most severe of them is intercourse. It is not permissible for a believer while fasting in Ramadan, if he is healthy and a resident, to consume things that break the fast, whether intercourse or anything else. It is also not permissible for him to coerce his wife to do so, and she must not consent to it; rather, it is obligatory for her to refrain. Both of you owe the expiation, which is: freeing a believing slave for each of you for each day. That means: three slaves for each day, one for him and one for her. So the total is six slaves: three for you and three for her for the three days, if she was consenting and not coerced.
If you are unable to do so, then it is obligatory for both of you to fast two consecutive months, each of you fasting two consecutive months for each instance of intercourse in a day. So you owe six months for the three days, and she owes six months for the three days, unless she was coerced, meaning: you forced her by force until she was unable to prevent you.
If you are unable to free slaves and fast, then it is obligatory for both of you to feed sixty poor people for each instance of intercourse, meaning: for each day on which intercourse occurred. The meaning is: feeding three expiations of sixty poor people, meaning: three times, thirty sa' (a dry measure of about 3 kg), and thirty sa', and thirty sa'; ninety sa' distributed among sixty poor people, each poor person receiving one and a half sa', for each day half a sa', and for her the same if she was consenting: ninety sa' for the three days, thirty sa' for each day for sixty poor people. These ninety sa' are given to sixty poor people, meaning: you pay them, each one is given one and a half sa' for the three days, half a sa' for each day. Half a sa' is approximately one and a half kilograms, meaning: four and a half kilograms for the three days of wheat, or rice, or dates, of the staple food of the country. This is what is obligatory for both of you, along with repentance, seeking forgiveness, remorse, and not returning to such a thing. You know your own situation best, so with the ability, freeing slaves is obligatory, and with inability, fasting is obligatory, and with inability to fast, feeding is the last resort.
