The Ruling on Praying Behind One Who Joined Late When He Missed the Friday Prayer

Question:
This is a letter from a listener (H. M. D.) from the People's Democratic Republic of Yemen, containing several questions. Some of them were answered in a previous episode. He has one question remaining, in which he asks: If a person comes to the mosque on Friday and finds that the prayer has been completed, and finds a man who has one rak'ah remaining, does he complete it as Zuhr or as Jumu'ah? And if another person joins him, after he has completed one rak'ah, does he also complete it as Zuhr, or does he complete it as Jumu'ah?
Answer:
It is obligatory for him to complete it as Zuhr; because the Jumu'ah prayer was missed since he did not catch any part of it. The Jumu'ah prayer is missed, and it is only caught by one rak'ah. If he catches the second rak'ah with the imam, he prays it as Jumu'ah. But if he does not come until after the taslim, or after the second rak'ah in the tashahhud, or in the state of prostration in the second rak'ah, then he does not pray it as Jumu'ah, but he prays it as Zuhr. This is based on the saying of the Prophet (peace and blessings be upon him):Bulugh al-Maram 2:366 The implication of this is that if he catches less than one rak'ah, he is not considered to have caught the Jumu'ah, but he prays Zuhr. This is what is prescribed: that he prays Zuhr. And if he catches a person making up the prayer and prays with him, he prays Zuhr and does not pray Jumu'ah. Yes.
This also requires noting that it should be after the sun has passed its zenith. As for if the Jumu'ah prayer was performed before the sun passed its zenith, then he does not pray Zuhr until after the sun has passed its zenith. It is permissible to pray Jumu'ah before the sun passes its zenith, at six o'clock before the zenith, and there is no harm in this according to the correct opinion. So if the Jumu'ah prayer was performed before he missed it, having been prayed before the sun passed its zenith, then he does not pray Zuhr until after the sun has passed its zenith. Yes.
