Ruling on Placing a Donation Box for the Mosque Next to an Adjacent Grave

Question:
The questions from our brother in Libya continue. He says: We have a mosque with two graves next to it, outside the mosque. One of them is inside a built room, on the pretext that it is a righteous close friend of Allah. There is a box inside the room designated for donations, where visitors put money, and this money is spent on what the mosque needs.
The question: What is the ruling on spending this money? What is the ruling regarding praying in it? And what do you advise us?
Give us a ruling, may Allah reward you.

Answer:
If the grave is outside the mosque, there is no harm in praying in the mosque, because it is independent in that case. The Messenger (peace and blessings be upon him) forbade making mosques over graves. He said:
Allah cursed the Jews and the Christians that they took the graves of their prophets as mosquesلعن الله اليهود والنصارى، اتخذوا قبور أنبيائهم مساجد
Sahih Muslim 529
So if the grave is outside that, in a room outside the mosque, there is no harm. But this grave must be moved to the Muslim cemeteries so that it is not exalted, so that it is not worshipped alongside Allah. And this box must be removed, because the ignorant people give money to draw near to the dead person, to the owner of the grave, because in their claim he is a close friend of Allah. So their drawing near to him with vows and charity, this is major shirk (associating partners with Allah) and is not permissible.
So it is obligatory for the authorities in the town to contact the scholars, and to remove this grave, and to move its remains to the Muslim cemeteries with the other graves, and to remove this room which may lead people to fitnah (trial, discord or temptation), and to remove the box. And this money in the box is to be spent on the interests of the Muslims, on the interests of the mosque, or the interests of the schools, or given to the poor, and the like of that; because it is lost money that has no owner in reality, so it is spent on public interests, and this box is removed.
And the people are informed that it is not permissible to draw near to the people of the graves, not with sacrifices, not with vows, and no prayer is performed at the grave, and no prayer is performed for them, and they are not called upon alongside Allah, and they are not called for aid, and no vows are made to them; because this is not permissible. Making vows to them is shirk (associating partners with Allah) with Allah, and calling upon them alongside Allah, as if one says: "O my master, I am near you, O my master, help, help," this is from major shirk (associating partners with Allah), of the same kind as the actions of the polytheists in the time of the Prophet (peace and blessings be upon him), from the people of Makkah and others.
The dead person is called for, and forgiveness is sought for him, and mercy is invoked upon him, but he is not called upon alongside Allah, he is not called for aid, no vow is made to him, and no sacrifice is slaughtered for him. So whoever does this with the dead, he has committed shirk (associating partners with Allah). Allah (Glorified and Exalted is He) said: :
(162) Say, "Indeed, my prayer, my rites of sacrifice, my living and my dying are for Allah, Lord of the worlds. (163) No partner has He. And this I have been commanded, and I am the first [among you] of the Muslims."قُلْ إنّ صلاتي ونُسُكي ومحْياي ومماتي للّه ربّ الْعالمين ۝ لا شريك لهُ وبذلك أُمرْتُ وأنا أوّلُ الْمُسْلمين
[Al-An'am: 162-163] And He said, the Exalted:
(1) Indeed, We have granted you, [O Muhammad], al-Kawthar. (2) So pray to your Lord and sacrifice [to Him alone].إنّا أعْطيْناك الْكوْثر ۝ فصلّ لربّك وانْحرْ
[Al-Kawthar: 1-2].
And he (peace and blessings be upon him) said in the authentic hadith regarding 'Ali (may Allah be pleased with him) , the Commander of the Faithful, that he said (peace and blessings be upon him):
Abu't-Tufayl said, "'Ali was asked, 'Did the Prophet, may Allah bless him and grant him peace, give you something special which he did not give to anyone else?' He replied, 'The Messenger of Allah, may Allah bless him and grant him peace, did not give me anything special which he did not give to everyone else except for what I have in my sword scabbard.' He brought out a piece of paper. Written on that paper was: 'Allah curses anyone who sacrifices an animal to something other than Allah. Allah curses anyone who steals a milestone. Allah curses anyone who curses his parents. Allah curses anyone who gives shelter to an innovator.'"لعن الله من ذبح لغير الله، لعن الله من لعن والديه، لعن الله من آوى محدثا
Al-Adab Al-Mufrad 17
— meaning: an innovator, or anyone else who introduces a new matter in the religion, and they are supported and given protection —

Slaughtering for other than Allah: drawing near to other than Allah, like praying for other than Allah, so it is not permissible to slaughter for so-and-so or so-and-so to draw near to him, for the so-and-so dead person and the so-and-so close friend of Allah, or for the jinn, or for the angels, drawing near to them, or for the prophets, worshipping them with this alongside Allah. This is not permissible. The sacrificial animal is for Allah alone (Mighty and Majestic) , and supplication is likewise, no one is called upon with Allah. Yes.
