The Ruling on Marrying a Woman Who Does Not Pray and Remaining with Her
Machine translationRead the Arabic original
Question:
Many questions have been received in which women complain that their husbands have abandoned prayer. What is the ruling on this? And should she remain with him? May Allah reward you with good.
Answer:
You have heard that prayer is the pillar of Islam; whoever preserves it preserves his religion, and whoever neglects it is more neglectful of everything else. You have also heard that abandoning it is major shirk (associating partners with Allah) according to the most correct opinion of the scholars, even if he does not deny its obligation. However, if he denies its obligation or mocks it, he is a disbeliever according to all Muslims—may Allah grant us safety.
Therefore, a man who does not pray, his wife should not remain with him. Rather, it is obligatory for her to separate from him and go to her family. She is more entitled to her children than he is, and has more right to them than he does, until Allah accepts his repentance. If he repents with a sincere, known repentance and wishes to return to her, there is no harm.
Likewise, if he prays and she does not pray, he should also separate from her until she repents to Allah with a sincere repentance; based on the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 1079Sahih (Darussalam), and what has come in the verses and hadiths with that meaning.

The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
