A Sudanese resident in Iraq, (Dr. H. J. A.), sent a message containing two questions. In his first question, he says: I proposed to a girl I wanted to marry, but the girl's father is a man who does not pray, and more dangerously, he is an addict to drinking intoxicants. Therefore, the girl I proposed to does not pray—that is, the daughter of this man addicted to intoxicants. Is it permissible for me to marry her or not?
Answer: It is not permissible for you to marry her until she prays; because abandoning the prayer is disbelief, as the Prophet (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.العهد الذي بيننا وبينهم الصلاة فمن تركها فقد كفر

And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة

Whoever abandons it while denying its obligation is a disbeliever by the consensus of the Muslims, and whoever abandons it out of negligence and laziness is a disbeliever according to the most correct of the scholars' opinions, whether he is a man or a woman.
Therefore, it is not befitting for you, nor is it permissible for you, to marry her while she is in this state, and you are a Muslim who prays, fasts, and fears Allah. It is not permissible for you to marry her until she repents to Allah and until she becomes upright in the prayer.
Likewise, a woman does not have the right to marry a man who does not pray if she knows that he does not pray, for it is not permissible for her to accept him or to be content with the contract with him. And if he abandons the prayer, it is obligatory for her to refrain from him until he repents to Allah. If he repents to Allah while she is in the waiting period, he is her husband, or if it is after the waiting period and she has not annulled the marriage, he is her wife according to the correct opinion. But after the waiting period, she has the right to demand the annulment of the marriage and take her right until she marries whom she wishes; because abandoning the prayer is apostasy from Islam according to the most correct of the scholars' opinions, even if he did not deny its obligation.
A group of scholars held the view that if he did not deny its obligation, he would not be a disbeliever with major shirk, but rather his disbelief would be minor shirk. However, this opinion is the weaker one, and the correct one is that it is major shirk because it is the pillar of Islam. The Prophet (peace and blessings be upon him) explicitly attributed disbelief to the one who abandons it, and he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.بين الرجل وبين الكفر والشرك ترك الصلاة
And the definite article "al" with "kufur" (disbelief) and "shirk" (associating partners with Allah) refers to major shirk.
And he (peace and blessings be upon him) also said:

And he spoke about the rulers who do not pray when he was asked (peace and blessings be upon him) about the rulers who do not pray... He was asked about the rulers who delay the prayer from its times, or about those from whom known sins are known and denied. He forbade fighting them and rebelling against them, and said:
unless we noticed him having open Kufr (disbelief) for which we would have a proof with us from Allahإلا أن تروا كفرًا بواحًا عندكم من الله فيه برهان

It is the pillar of Islam; whoever preserves it preserves his religion, and whoever neglects it is more neglectful of what is besides it.
And 'Umar ibn al-Khattab (may Allah be pleased with him) used to write to his governors and say: "The most important of your affairs to me is the prayer. Whoever preserves it has preserved his religion, and whoever neglects it is more neglectful of what is besides it." And the Prophet (peace and blessings be upon him) mentioned the prayer one day among his Companions and said:
If anyone keeps to it, it will be light, evidence and salvation for him on the day of resurrection; but if anyone does not keep to it, it will not be for him light, evidence, or salvation, and on the day of resurrection he will be associated with Qarun, Pharaoh, Haman, 1 and Ubayy b. Khalafمن حافظ عليها كانت له نورًا وبرهانًا ونجاة يوم القيامة، ومن لم يحافظ عليها لم يكن له نور ولا برهان ولا نجاة، وحشر يوم القيامة مع فرعون وهامان وقارون وأبي بن خلف

And these disbelievers were occupied with their worldly life from obeying Allah and worshipping Him. So whoever abandons the prayer has become like them, and he will be gathered with them, we seek refuge in Allah. If he abandoned it for the sake of leadership, he has become like Pharaoh, and he will be gathered with him on the Day of Resurrection. And if he abandoned it for the sake of ministerial office, he has become like Haman, the minister of Pharaoh, and he will be gathered with him on the Day of Resurrection, into the Fire, we ask Allah for safety. But if he abandoned it for the sake of wealth and desires, he is like Qarun, whose wealth and desires occupied him from following the truth until Allah caused the earth to swallow him and his home, we seek refuge in Allah from that. And if he abandoned it for the sake of buying and selling and managing trade, he is like Abu Jahl, the merchant of the people of Mecca, whose buying and selling and trade occupied him from obeying Allah and His Messenger, and from following the Prophet Muhammad (peace and blessings be upon him). So whoever abandons the prayer by being occupied with trade is like this, we ask Allah for safety, and he will be gathered with him on the Day of Resurrection, we seek refuge in Allah from that.
It is obligatory to be cautious, and one of the great misfortunes is the large number of people who now abandon it or are lax about it, either completely or in the mosques. This is a great affliction, a great evil, and a great wrong. It is obligatory to be cautious of this, and it is obligatory to advise one another to perform it and to be upright in it among the members of the household, both men and women. It is obligatory to advise one another and cooperate in this, so that a man establishes the prayer with his household, his wife, his children, and his servants, without being lax in this. Rather, he must be a good role model for his wife, his children, his servant, his driver, and the like. The prayer is the pillar of Islam; whoever preserves it preserves his religion, and whoever neglects it is more neglectful of what is besides it. Allah the Exalted says:
Maintain with care the [obligatory] prayers and [in particular] the middle prayerحَافِظُوا عَلَى الصَّلَوَاتِ وَالصَّلاةِ الْوُسْطَى
[al-Baqarah:238] And the Prophet (peace and blessings be upon him) said:
And establish prayer and give zakah and bow with those who bow [in worship and obedience].وَأَقِيمُوا الصَّلاةَ وَآتُوا الزَّكَاةَ وَارْكَعُوا مَعَ الرَّاكِعِينَ
[al-Baqarah:43] And the verses concerning it are numerous, as are the hadiths, because of its great importance. We ask Allah for guidance for us and for all Muslims.
