The Ruling on Obeying One's Father in Marrying a Man Who Does Not Pray

Machine translationRead the Arabic original
Question:
The questioner (M. M. M) from Riyadh says: My father wants to marry me to my cousin, even though he does not pray at all. He says: If you do not obey my command, I will be angry with you until the Day of Judgment. I sought the mediation of people of good, but I did not succeed. My uncle says to my father: If you do not marry your daughter to my son, then separation is between me and you. So what is the solution, O honorable Shaykh?

Answer:
It is not permissible for them to force her to do this, and it is not permissible for her to do it either, nor for them either. It is obligatory that they help her in good. She has no right to agree to a man who does not pray, and they have no right to force her to do so. The one who does not pray is a disbeliever, we seek refuge in Allah. The Prophet (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
And he (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
Sunan Ibn Majah 1079Sahih (Darussalam)
.
So it is not permissible for her to accept, even if they are pleased, she has no right to accept. It is obligatory for her to refrain, and it is not permissible for them to force her, neither her uncle nor her father. This indicates the little religion of both of them, the little religion of the father, and the little religion of the uncle. How can they force her to a man who does not pray? I seek refuge in Allah. Rather, it is not permissible for them to marry her to him, and it is not permissible for her to be pleased with it. The marriage is invalid, if they married her to him. A disbeliever does not marry a Muslim woman. Allah (Exalted and Majestic is He) says:
And do not marry polytheistic men [to your women] until they believe
[al-Baqarah:221] And He says:
they are not lawful [wives] for them, nor are they lawful [husbands] for themلا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ
[al-Mumtahanah:10].
So the correct view, which the Islamic evidences are based on, is that the one who abandons prayer is a disbeliever. This is the truth, and it is what the Islamic evidences are established upon. Among them is his (peace and blessings be upon him) saying in Sahih Muslim from Jabir (may Allah be pleased with him) He (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
And he (peace and blessings be upon him) said:
The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
Sunan Ibn Majah 1079Sahih (Darussalam)
And the Prophet (peace and blessings be upon him) said:
The head of the matter is Islam, and its pillar is the Salat
Jami` at-Tirmidhi 2616Hasan (Darussalam)
And Abdullah ibn Shaqiq al-Aqili (may Allah have mercy on him) said: "The Companions of the Prophet (peace and blessings be upon him) did not consider anything whose abandonment is disbelief except prayer." They considered its abandonment to be disbelief, meaning: major shirk.
So the point is: she is to be thanked, and she has done well, and this is what is obligatory upon her. If they married her, they would have sinned, and the contract is invalid. Yes.

The presenter: May Allah reward you, Your Eminence.
