The Ruling on Obeying a Husband in Uncovering the Face Before Non-Mahrams

Machine translationRead the Arabic original
Question:
I ask you, O honorable Shaykh, to forgive me; for I have erred against you while being ignorant. She states in her question that she is a married woman, and her husband orders her to uncover her face before her brothers and uncles, and to sit with them, knowing that this is a custom of the pre-Islamic age of ignorance. She asks you to advise him so that he may hear your advice. May Allah reward you with good.

Answer:
As for what concerns forgiveness for what has occurred from you of backbiting, you and others are forgiven. Everyone who spoke about my honor is forgiven. We ask Allah to forgive everyone, and to guide everyone to His straight path.
As for what concerns uncovering: It is obligatory for the husband—may Allah guide him—to fear Allah, and not to assist you in falsehood. Rather, he must assist you in good, and hijab is better for him and for you. But due to the weakness of his jealousy and the weakness of his insight, he orders you to drop hijab. This is due to the weakness of jealousy and the lack of insight. So it is obligatory for him to order you to observe hijab, and to assist you in it with his brothers, uncles, and others. And Allah the Exalted says:
And when you ask [his wives] for something, ask them from behind a partition. That is purer for your hearts and their hearts.
[Al-Ahzab: 53].
So it is obligatory for you to observe hijab and to fear Allah in that. It is not permissible for you to obey him in uncovering before his brothers, uncles, and the like, even if it is their custom. A custom that contradicts the Shari'ah must be abandoned. The Shari'ah rules over people; it is not the custom that rules over people. The noble Shari'ah is what rules over people, and it changes customs. The people of the pre-Islamic age of ignorance used to worship idols and statues, so the Shari'ah came and invalidated that. Likewise, they used to gamble, commit zina, and drink intoxicants, so the Shari'ah came and invalidated that. So customs that contradict the Shari'ah must be abandoned.
And it is not permissible for the husband, nor for anyone else, to assist his wife in falsehood, or to allow her in falsehood. And it is not permissible for the wife to obey him in falsehood. The Prophet (peace and blessings be upon him) said:
Obedience is in matters which are good and universally recognized.إنما الطاعة في المعروف
Sunan Abi Dawud 2625Sahih (Al-Albani)
,
A creature is not to be obeyed when it involves disobedience to the "Creator.”لا طاعةَ لمخلوقٍ في معصية الخالق
Mishkat al-Masabih 3696
.
So it is obligatory for husbands to fear Allah, and to beware of the anger of Allah, and to assist their wives in good, not in evil. And it is obligatory for wives also to obey Allah in that, and to fear Allah in that, and to assist their husbands in good. They must assist their husbands in maintaining the prayers, in waking them for prayer, in advising them in good. So the wife assists her husband, and he assists her also in good, as Allah the Exalted said:
cooperate in righteousness and pietyوَتَعَاوَنُوا عَلَى الْبِرِّ وَالتَّقْوَى
[Al-Ma'idah: 2]. And likewise, the brother with his sister, the father with his daughter, and the uncle with his nephew's daughter; they cooperate in good, guidance, and righteousness.
