What is the ruling in the religion regarding a husband who does not have intercourse with his wife except very rarely, and even when he does, he does so with reluctance, knowing that the wife will suffer harm from this? May Allah reward you with good.
Answer:
As long as he has intercourse with her, praise be to Allah, even if he does so with reluctance. However, if he refuses to have intercourse with her and refuses to do so, this is referred to the court if they do not agree on reconciliation in separating from her, or if he gives her something that satisfies her regarding it, or if they agree on separation by her giving him her mahr or part of it and he separates from her. These matters between a woman and her husband are either that they reconcile, or that they refer the matter to the judge.
And if he is excused and does not have the ability, the judge looks into the matter. But if he is able, it is obligatory for him to have intercourse with her and to chaste her, and he has no right to harm her. If he intends to harm her, he is compelled to do so. And Allah, Exalted and Majestic is He, commanded to give the one who takes an oath to abstain from his wife a respite of four months; the one who swears not to have intercourse with his wife, Allah gives him a respite of four months. He, the Exalted, said:[Al-Baqarah 2:226] And if they are determined to divorce, then indeed Allah is Hearing and Knowing [al-Baqarah: 226-227]. So he is given a respite of four months; if he fulfills it and has intercourse, otherwise he is compelled to divorce.
