Question:
If the insane person and the unconscious person regain consciousness after the time for prayer has passed, do they make up the prayer?

Answer:
The insane person does not, for he is not accountable. If he became insane before the time for prayer entered, the obligation is lifted from him. As for the sleeping person, he makes it up. The unconscious person is like the sleeping person; if he regains consciousness, he makes it up on that day, or the next day, or the third day, as was narrated from 'Amir ibn Yasir (may Allah be pleased with him) and a group of others. Some scholars said: If he is unconscious for a full day, there is no making up, but if it is less than a day, he makes it up. The most likely view—and Allah knows best—is that he is like the sleeping person: if it is one day, two days, or three days, he makes it up, but if it is more than that, he does not make it up.
