Q: I submit my problem to you, after Allah the Exalted, which is: that during three consecutive years, and in every month of Ramadan during these years, in the first year I abstained from food and drink and had intercourse with my wife for twenty-five days of Ramadan , and I was ignorant of the ruling. In the Ramadan that followed, I also had intercourse with my wife for fifteen days. In the Ramadan after that, I also committed the act with my wife during the daytime of Ramadan for five days, while I was fasting from food and drink. I did not know that intercourse invalidates the fast. I ask you to inform me about this problem, knowing that the intercourse occurred during the daytime of Ramadan.
A: First: It is obligatory for you to repent to Allah Mighty and Majestic and seek forgiveness for what occurred
from you, and likewise from your wife. Second: It is obligatory for you to pay an expiation for every day in which you had intercourse. The expiation is: freeing a believing slave. If you do not find one, then you fast two consecutive months. If you are unable to do so, then you feed sixty poor people for every day, with each poor person receiving half a sa' (a dry measure of about 3 kg) of the local staple food, which is approximately one and a half kilograms. Third: It is obligatory for you to make up the days in which the intercourse occurred. If you delayed making them up until another Ramadan caught up with you, it is obligatory for you, along with making them up, to feed a poor person for every day, which is half a sa' of the local staple food, equivalent to approximately one and a half kilograms. Fourth: It is obligatory for your wife to do what is obligatory for you regarding repentance, expiation, and making up the fasts. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
