The ruling on a wife who does not pray and does not observe the hijab

Machine translationRead the Arabic original
There is a message from Sudan, sent by one of the brothers from there, who is actually asking about his wife. Our brother says: He is married, and his wife has not learned anything of the Noble Qur'an, and she does not establish the prayer. He has tried with her for ten years, but she has not responded to this day. He also says: She does not wear the Islamic dress, and she has not accepted any advice or guidance regarding this matter. He is consulting your eminence about her situation?
Answer: If she does not pray, the matter is finished. The one who does not pray has no religion; rather, he is a disbeliever. We ask Allah for safety. The Prophet (peace and blessings be upon him) said:
The covenant between us and them is prayer, so whoever abandons it has disbelieved
It was narrated by Imam Ahmad in al-Musnad, and by Abu Dawud, al-Tirmidhi, al-Nasa'i, and Ibn Majah with a sound chain from Buraydah (may Allah be pleased with him). And he (peace and blessings be upon him) said:
The head of the matter is Islam, and its pillar is the Salat, and its hump is Jihad
Jami` at-Tirmidhi 2616Hasan (Darussalam)
So if he leaves the pillar, what remains for him? And he (peace and blessings be upon him) said:
Between a man and disbelief and shirk (associating partners with Allah) is the abandonment of prayer.
It was narrated by Muslim in al-Sahih. The expression "the man" does not exclude the woman; because this is the custom of the Prophet (peace and blessings be upon him). He may express it as "the man" and he may express it as "the woman," and the ruling is general for everyone. What is established for men is established for women, except with evidence that specifies one of them.
So the result is that this woman, in addition to not praying, also does not wear the Islamic dress; this indicates a sickness in her heart that inclines her toward the disbelievers and the dress of the disbelievers.
So my advice to you, O questioner, is to part with her, as long as you have been with her for a long time, ten years, and you have not succeeded in advising her or guiding her to good, what do you hope for from her? Women are many, and praise be to Allah
And whoever fears Allah - He will make for him a way out (3) And will provide for him from where he does not expect.
[Al-Talaq: 2-3]. And He, the Exalted, says:
And whoever fears Allah - He will make for him of his matter ease.
[Al-Talaq: 4]. So part with her and be glad of the great good and the good outcome. And with this, ask Allah for her guidance. We ask Allah for guidance for us and for her. And if you advise her as a last thing and explain to her that if she does not respond, you will part with her, then perhaps this will benefit her somewhat.
The presenter: May Allah reward you. He mentions his connection to the children, O Shaykh.
The Shaykh: He is more entitled to his children; she has no custody. As long as she is in this state, she has no custody. He is more entitled to his children in every case. He is more entitled to his children, and the remaining of his children with her harms them and may lead them to much evil. So the result is that the Muslim is more entitled to his children absolutely. Yes.
The presenter: May Allah reward you with good.
