The following message reached the program from listener Ali Hasan Abd al-Rahim Khalid from the Lebanese Republic, in which he says: I ask you to please clarify the meaning of the noble verse in His saying (peace and blessings be upon him): [al-Baqarah:197]. Sometimes disputes occur between some of the pilgrims, and quarreling takes place among them. I ask for information: Is there a sin in that, and what is the expiation? Please inform us, may Allah reward you?
Answer: Allah the Exalted says: [al-Baqarah:197]. And the Prophet (peace and blessings be upon him) said: Sahih al-Bukhari 1521.
This indicates to us that the pilgrim should not commit indecency, nor transgress, nor quarrel. Rather, he should occupy himself with the remembrance of Allah, obedience to Allah (Glorified and Exalted is He), and beneficial, good speech. He should stay away from what is not appropriate, such as indecency, transgression, and quarreling; because he is in a great act of worship, and he should respect it and protect it from what is not appropriate. Indecency (rafath) is intercourse with one's wife before exiting the state of ihram, before throwing the pebbles, shaving, and performing tawaf and sa'y if sa'y is required of him, and before she does the same. So they are not permitted to have intercourse except after completing the important acts of Hajj that follow the first exit from ihram, which are throwing the pebbles on the Day of Sacrifice, shaving or shortening the hair, along with tawaf al-ifadah and sa'y for those upon whom sa'y is required. If he does these things, or if his wife has done these things, then intercourse is permissible for them. Otherwise, it is forbidden for them, and that is indecency (rafath), as Allah the Exalted said: [al-Baqarah:187]. Indecency (rafath) is intercourse, and likewise the speech that leads to it is called indecency (rafath), such as talking with her about intercourse, kissing her, touching her, and the like of that. All of that which relates to intercourse is indecency (rafath). As for transgression (fisq), it is sins such as cursing, insulting, lying, usury or interest (riba), false testimony, undutifulness to parents or one of them, severing family ties, and other sins. It is obligatory to avoid them always, always. But in Hajj, it is more severe. Sins must be avoided, for they are transgression (fisq), ...... to be avoided in Hajj and elsewhere, in every place and time. But in Hajj, they are more forbidden and more sinful. So it is obligatory for the pilgrim to avoid every sin.
As for quarreling (jidal), it is of two types: One type relates to the feelings of Hajj, the seasons of Hajj, and the acts of Hajj. Allah has clarified these, so there is no quarreling in them. It is not appropriate to quarrel about them. Allah has clarified the landmarks of Hajj, and clarified the rituals and rulings of Hajj. So quarreling about that is not permissible. Rather, it is obligatory for Muslims to follow their Prophet (peace and blessings be upon him) in that, and to perform Hajj as he performed it, in all matters: standing at 'Arafah, staying overnight at Muzdalifah, staying overnight at Mina, throwing the pebbles, tawaf and sa'y, and so on. There is no need for quarreling, for Allah has made the matter clear.
The second type: Quarreling between people and disputes between people. It is not appropriate to quarrel among them in a way that causes enmity, trial, discord or temptation (fitnah), or beating or fighting. If talking leads to quarreling, it should be left. It is not appropriate to expand on that. A person talks with his brother about his affairs and needs, but when the matter leads to quarreling, harshness, and argument that may lead to beating or enmity, it should be left. This is how the believer should be with his brothers in Hajj: they should avoid both types of quarreling, so that their Hajj is sound and free from what affects it, such as indecency, transgression, or quarreling. And Allah is the One to be sought for help. Yes.
there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj
فَلا رَفَثَ وَلا فُسُوقَ وَلا جِدَالَ فِي الْحَجِّAnswer: Allah the Exalted says:
Hajj is [during] well-known months, so whoever has made Hajj obligatory upon himself therein [by entering the state of ihram], there is [to be for him] no sexual relations and no disobedience and no disputing during Hajj.
Whoever performs Hajj for Allah's pleasure and does not have sexual relations with his wife, and does not do evil or sins then he will return (after Hajj free from all sins) as if he were born anew.
