Machine translationRead the Arabic original
Question:
What is the ruling on one who had intercourse with his wife during the day in Ramadan while he was ignorant of the ruling, and after that he repented with a sincere repentance and several years have passed? So what is the ruling in the present time after these years have passed?
Answer:
It is obligatory for him to pay the expiation; because this is a known matter and it is not hidden from people. Intercourse in Ramadan is forbidden, and his claim of ignorance is not correct. And even if we accept that, he is one who is lax and neglects to study his religion. The Companions are the majority of those who stated that he owes the expiation. And the Prophet (peace and blessings be upon him) issued a fatwa in this manner: that he owes the expiation, and he did not ask him whether he was ignorant or not. A man came to him saying: O Messenger of Allah, I am ruined; I had intercourse with my family in Ramadan. So the Prophet (peace and blessings be upon him) issued a fatwa for him regarding the expiation. And the Companions issued fatwas regarding expiations for those who committed what necessitates an expiation in their Hajj, and in their fasting, and they did not ask them for details. And because in this there is blocking the door to laxity and the claim of ignorance.
And the expiation is known: freeing a believing slave. If he is unable, he fasts two consecutive months. If he is unable, he feeds sixty poor people. This is the expiation for zihar, and it is the expiation for intercourse in Ramadan.
