Q: I have been married for more than thirty years. I am a Bedouin man who cannot read or write, and I have no knowledge, nor are there any guides for us. We are ignorant of the matters of our religion. Then, I had intercourse with my wife in the month of Ramadan after the Fajr prayer, and she was willing . Then, we all broke our fast that day, and we were young at the time. It was the first month we fasted. My belief was that since I was in a state of major ritual impurity from the night, because I had also had intercourse with her at night and we did not find water, it was not permissible for us to fast without performing the full ritual bath. So, I had intercourse with her after Fajr, and we were ignorant that intercourse is not permissible while fasting, in our youth and ignorance.
A: It is obligatory for each of you to repent to Allah (Glorified and Exalted is He) and not to return to such an act. It is also obligatory for you to pay the expiation, which is: freeing a slave for each
of you. If you cannot find one, then you must fast two consecutive months. If you are unable to do so, then each of you must feed sixty poor people, giving each poor person half a sa' (a dry measure of about 3 kg) of the local staple food. It is also obligatory for you to make up the day on which the intercourse occurred. If you delay making it up until another Ramadan, you must give out half a sa' (a dry measure of about 3 kg) of the local staple food to the poor for each day on which the fast was broken, which amounts to one and a half kilograms for each day. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
