Question:
I got married eight days before Ramadan, and one day I woke up in a state of major ritual impurity and broke my fast that day... so I broke my fast on the second day and caressed my wife, so I broke my fast like that... What is the ruling of the Shari'ah in this matter?

Answer:
A person waking up in a state of major ritual impurity does not prevent him from fasting. He may have intercourse at night, but he should not take a bath until after dawn; this does not harm him. It is not permissible for him to break his fast because of that. The Prophet (peace and blessings be upon him) would sometimes have intercourse with his wives at night, then wake up in a state of major ritual impurity, then take a bath and go to prayer, peace and blessings be upon him. There is no blame on a person delaying the bath until he eats the pre-dawn meal, then taking a bath after the call to prayer, after dawn; that does not harm him, provided that he hastens so that he attends the congregation.
As for intercourse in Ramadan, this is abominable and one of the major sins. It is not permissible for a resident to have intercourse in Ramadan; rather, he must avoid his wife during that time and be content with the night. If something happens to him during the day, such as having intercourse with his wife, he must repent to Allah, and he owes an expiation, which is freeing a slave if he is able. If he is unable, he must fast two consecutive months. If he is unable, he must feed sixty poor people, thirty sa' (a dry measure of about 3 kg) of wheat, or dates, or rice, from the staple food of the country, for sixty poor people, thirty sa' for sixty poor people, if he is unable to free a slave, and unable to fast two consecutive months, along with making up the day, and hastening to make up that day and the other. And each one must pay an expiation if they consented to it; the expiation is on both of them, freeing a slave for each one. If they are unable, each one must fast two consecutive months. If they are unable, they must feed sixty poor people, each one feeding thirty sa', meaning sixty sa' for both of them for sixty poor people, each poor person receiving one sa', half a sa' from the man and half a sa' from the woman, from the staple food of the country: from sorghum, or barley, or wheat, or raisins, or rice, or something else.

Question : Okay, what if it happens three or four times?

Answer: Every time it happens, he owes an expiation for each day. If it is two days, two expiations; if it is three days, three expiations.

Question : What if he is a traveler?

Answer: As for if he is one of those who travel; it does not harm. If they are both travelers; there is nothing wrong with it if the fast is permitted for him to break by eating; it is permitted for him to have intercourse.
