Fatwa number ( 17704 )
Q: I went for Hajj as a mutamatti' with a group, and during the arrival tawaf, I lost my money. All that remained with me was 550 riyals, five hundred and fifty riyals, which I gave to a person to keep safe for me. When we were performing the rites, I told him: You have to provide the hady, and I do too. This is an agency from me, just as
you do for yourself, do for me; because my money is with you, if you pay it in the bank or slaughter it, do for me what you do for yourself, whether you are present with me or we separate. I said this out of fear of separating. After agreeing to this, and while we were in the tawaf al-ifadah, we actually did separate due to the heavy crowd. This was before the hady. I spent all the days of Tashreeq looking for him and did not find him. For the record, I had no money with me, and I returned to my place of residence in Tabuk on Sunday, and he returned after me. When I asked him about the hady, he said: I did not sacrifice for you. Please advise us, may you be rewarded, after I have cleared my responsibility before Allah and appointed him as my agent, reassure us. May Allah reward you with good.
A: It is obligatory for you to slaughter the hady in Makkah to make up for it, and to prepare with its meat what you prepare with it during the days of Tashreeq; because it is an obligation in your debt, so it must be fulfilled, and you must hasten to do it yourself or through a trustworthy agent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
