The Elder Who Cannot Fast: If He Dies, He Pays on His Behalf

Machine translationRead the Arabic original
The first question of Fatwa No. ( 21209 )
Q1: My grandmother (may Allah have mercy on her) passed away, and two years have passed since her death without her fasting the month of Ramadan. Please note that she was ill and her mind was not fully intact. What is the ruling? Do I give charity for every day she did not fast, or what is required in this matter?
A1: It is obligatory for you to feed one poor person for every day, half a sa' of the local staple food, based on the statement of Ibn 'Abbas (may Allah be pleased with them both) regarding the saying of Allah the Exalted:
And upon those who are able [to fast, but with hardship] - a ransomوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ
[Al-Baqarah 2:184]
He said: (It is not abrogated; it is for the elder who cannot fast). It was narrated by al-Bukhari (may Allah have mercy on him). If she was lacking in her mind, then she owes nothing; based on the saying of the Prophet (peace and blessings be upon him):
The pen has been lifted from threeرفع القلم عن ثلاثة...
Jami` at-Tirmidhi 1423Hasan (Darussalam)
and among them he mentioned:
the insane person until he regains consciousnessالمجنون حتى يفيق
.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
