Fatwa number ( 17239 )
Q: My mother and my father went to Makkah al-Mukarramah in order to perform the obligatory Hajj, combining 'Umrah with Hajj (tamattu'). They performed the 'Umrah with ease and simplicity, and praise and grace belong to Allah. During the performance of the Hajj rites, specifically during the sa'y, my mother was unable to complete the sa'y, as she completed five rounds, but in the fifth round she became exhausted and was unable to finish it , because she has suffered from a skin disease for more than ten years, and this disease worsens with the heat and the heavy crowds. Her father and the members of the group with him left her at one of the corners of the sa'y area, and they completed the rounds that were required of them. After that, they took her and tried to find a vehicle (a cart) for her, but they did not find one. When they returned to their tent, they inquired about the situation, and they were told: She must complete the sa'y before leaving Makkah al-Mukarramah . When they went for the farewell tawaf, my mother, my father's wife, and the brothers who were with them in the group performed the tawaf. My father became exhausted in the first round of the tawaf, as he was struck by a
sunstroke after returning from the sa'y, and he was admitted to one of the hospitals in Makkah , and he was unable to complete the tawaf. They took him out away from the crowds and left him outside the mosque, and they completed the tawaf that was required of them. They returned, took my father, and left Makkah to return to al-Madinah al-Munawwarah , and then to their family in the city of Hafar al-Batin . There was a woman with them in the group who was afflicted with possession by jinn, and this happened after she had performed the 'Umrah with the group with ease and simplicity. After the completion of the 'Umrah, she was afflicted with what we mentioned to your eminence, and she did not complete the Hajj rites at all. This was one of the reasons that made the group hasten to leave Makkah al-Mukarramah . The woman went to Makkah al-Mukarramah intending to perform Hajj for the first time. I ask your eminence to issue a fatwa to me regarding the ruling on my mother's and my father's Hajj, and what is obligatory upon them and when? And what is the ruling on the Hajj of the woman who was possessed by jinn; is her Hajj accepted or not? Please inform us, and may Allah reward you with good.
A: First: As for your mother, she must return to Makkah and perform the sa'y of Hajj between al-Safa and al-Marwah for seven rounds, then perform the farewell tawaf. If her husband had intercourse with her during this period, she must pay an expiation consisting of a sacrificial animal that is sufficient as an 'Id sacrifice, which is slaughtered in Makkah and distributed to the poor of the Haram. Second: As for your father, he must pay an expiation for leaving the farewell tawaf, which is slaughtered in
Makkah and distributed to the poor of the Haram. Third: As for the woman who was afflicted with insanity, if she was afflicted with this insanity after the completion of the 'Umrah and before entering the state of ihram for Hajj, then she owes nothing. However, if she has not performed the obligatory Hajj, she must perform Hajj when she recovers. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
