Stoning on behalf of a pilgrim without his permission

Machine translationRead the Arabic original
Fatwa number ( 20871 )
Q: I performed Hajj twice in the past. At that time, there were few guides, and we followed the example of our companions who had performed Hajj before us. Now, after the guides have become numerous, praise be to Allah, it has become clear to me that we were committing the following errors due to our ignorance:First:We did not know the three types of Hajj, so we would perform Hajj with the intention of Ifrad, but we would enter the state of Ihram for both Hajj and 'Umrah together, entering the state of Ihram for 'Umrah from the Mosque of Tan'im immediately after departing fromMinadirectly.Second:We would stay on the Day of Tarwiyahat al-Akhdhaynuntil the day of'Arafah . Third:We would standat 'Arafahuntil we prayed the midday and afternoon prayers, then we would return to the old markers until sunset . Fourth:We take from the treesof Minamiswak and firewood, which is green . Fifth:On the days of Tashreeq, we stone the pillars before noon . Sixth:One of us, on the day of departure, stoned the pillars on behalf of another person without his permissionand did not make up the stoning. Please issue a ruling, may Allah reward you, on what is required of us in this matter, knowing that some of us have performed Hajj since then, praise be to Allah.
A: First: What you did of performing Ifrad for Hajj, then performing 'Umrah afterwards from Tan'im after completing the acts of Hajj, is a permissible act, although the better
and more excellent option is to enter the state of Ihram for Tamattu' or Qiran, along with slaughtering the sacrificial animal for those who are able to do so, or fasting for ten days, three of which during Hajj and seven when returning. Second: It is better for the pilgrim to stay on the Day of Tarwiyah, which is the eighth of Dhul-Hijjah, and the night of the ninth, in Mina , and if he stays elsewhere, that is permissible. Third: If you did not leave 'Arafah before sunset in a final departure, then your standing in any place of 'Arafah is a valid standing; based on the saying of the Prophet (peace and blessings be upon him):
All of ‘Arafat is the place of standing, but keep away from the interior of ‘Uranahعرفة كلها موقف وارفعوا عن بطن عرنة
Sunan Ibn Majah 3012Da’if (Darussalam)
. And if you left 'Arafah before sunset and did not return to it, then you are required to pay a fidyah by slaughtering a sheep in Makkah that is acceptable as a sacrificial animal, to be distributed among the poor of the Haram. Fourth: What happened from you of taking something from the trees of Mina out of ignorance on your part, you owe nothing for it. Fifth: What happened from you of stoning on the days of Tashreeq before the sun reached its zenith is a stoning that does not suffice, and each one of you is required to slaughter a fidyah that is acceptable as a sacrificial animal, to be distributed among the poor of the Haram. Sixth: Stoning on behalf of another person does not suffice except by agency from him, and on the condition that he is unable to stone with his own hand, so what happened of stoning on behalf of another person without agency from an excused person does not suffice, and this person
for whom the stoning was done without his permission is required to slaughter a fidyah in Makkah that is acceptable as a sacrificial animal, to be distributed among the poor. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
