Q: My wife and I went to Makkah and the sacred sites to perform the obligatory pilgrimage, leaving our son and daughter, who are children, in the care of an Egyptian family. We stayed with my full brother in Makkah , who was performing Hajj as part of a delegation of more than 80 people coming from Egypt . This delegation was led by an elderly man accompanied by two assistants. This leader has been leading delegations for the past eight years and continues to do so. We were linked with them regarding accommodation, transportation, and every small and large matter related to Hajj. We performed the rituals in peace and safety, but I have
some very important questions, and I want to know my position and my wife's position regarding them: 1 – We left 'Arafah around 9:00 PM on Friday, and we passed through Muzdalifah and collected most of the pebbles for stoning from there. There was no opportunity to perform the Maghrib and 'Isha' prayers combined as delayed; the bus driver said: "No one is getting off the bus; because the conditions are not suitable regarding the parking space," and the head of the delegation agreed with him. We prayed Maghrib and 'Isha' in Mina around 2:30 AM, as we arrived in Mina at that time. Only a few individuals performed the Maghrib and 'Isha' prayers in Muzdalifah quickly. What is my position and my wife's position regarding this, and what is the position of the head of the delegation? 2 – I asked the head of the delegation to be my proxy and my wife's proxy for stoning on Sunday and Monday. He told me: "You and your wife should stone on Sunday, and appoint someone to act as your proxy on Monday." The reason for this proxy request was my extreme worry about my children; I had a dream that made me fear greatly for them. When we went to collect them from those responsible for them, we found our son injured on the lower part of his chin and stitched with three stitches. 3 – If I and my wife owe a sacrificial animal or animals, do I have the right to carry it out in Egypt , my country, or in Mina , or in Makkah ?
4 – And is the head of the delegation – who issued this ruling to me regarding the proxy for stoning and prayed Maghrib and 'Isha' with us in Mina – sharing the burden with me, or does he bear the burdens on my behalf? May Allah guide you to what He loves and is pleased with, and may Allah reward us with the best reward.
A: First: It is obligatory for pilgrims to stay overnight at Muzdalifah on the night of the sacrifice. A dispensation is granted to the weak, such as women, to leave Muzdalifah after midnight. It is better to leave after Fajr and the light of dawn for those who are able. If you left before midnight, you must offer a sacrificial animal to compensate for the ritual, to be slaughtered in Makkah and distributed to the poor of the Haram . Your wife is in the same position as you. Second: Your appointment of a proxy for stoning on your behalf and your wife's behalf on Monday due to traveling to your country is not valid. Each of you must offer a sacrificial animal that is sufficient as an 'Id sacrifice, to be slaughtered in Makkah and distributed to the poor of the Haram . And each of you must pay a fidyah for leaving the farewell tawaf. If you performed the farewell tawaf, it is not valid because it occurred before its proper time. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
