Fatwa number ( 21845 )
Q: About two years and three months ago - and I had not yet married -
I went to perform 'Umrah in the month of Ramadan, so I entered the state of ihram and made a condition. Then I went to Makkah , performed tawaf, and went to perform sa'y. In the sa'y area, due to the crowd and contact with women, as there were women displaying their adornment, I was overcome by a strong desire. I was in the fifth lap approximately, and I did not complete the sa'y out of fear of fitnah. So I went outside the mosque and was thinking of a way to strengthen myself to forget these temptations. Satan suggested to me masturbation, thinking that in this way my soul would calm down and I would complete the 'Umrah. So I masturbated, but the matter got worse, and I was unable to complete the remaining laps of the sa'y - which were two or three. So I shaved my head, took off the ihram clothes and put on my regular clothes, and left without completing the 'Umrah. I also broke my fast that day. Then, after about a year and two months, I performed the obligatory Hajj - as ifrad - and after about two months, I contracted the marriage. My wife and I then performed 'Umrah together, but I did not intend that this 'Umrah was a correction of the previously mentioned defective 'Umrah. After that, specifically in last Ramadan, I intended to perform 'Umrah in place of the defective 'Umrah. So I intended from here in Riyadh , without intending from the miqat that this 'Umrah was a correction of the previous 'Umrah. So I performed the 'Umrah, and praise be to Allah. What is the ruling on my action? May Allah reward you with good.

A: If the situation is as described, then the Hajj you performed is not valid as Hajj; because you entered the state of ihram for it while still in the state of ihram for a previous 'Umrah that you had not completed. It is considered a continuation of the first 'Umrah and a completion of the sa'y that you left. And the marriage contract you contracted after completing that 'Umrah is considered a valid contract. You must slaughter a sheep that is acceptable for the 'Id sacrifice, to be slaughtered in Makkah as expiation for your emission of semen by practicing masturbation before completing the 'Umrah. That fidyah is to be distributed to the poor of Makkah . And you must perform Hajj if you have not yet performed the Hajj of Islam; because the Hajj you mentioned was not valid for the reason we mentioned. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
