Q: I went to perform 'Umrah about six years ago, and during the tawaf, menstruation started, and I continued the tawaf, performed the sa'y, and completed the 'Umrah, knowing that tawaf around the House is not permissible, but I thought that my 'Umrah was invalid and that my ihram would be lifted as soon as the 'Umrah became invalid, knowing that I got married after that. What is the ruling? May Allah reward you with good.
A: If the matter is as you described, then the marriage contract is not valid, because it took place while you were in a state of ihram. It is obligatory for the husband to refrain from having sexual relations with you, and for you to return to Makkah and perform the tawaf, sa'y, and cutting of the hair to complete the defective 'Umrah due to the intercourse. Then, you must return to the miqat from which you entered ihram for the first 'Umrah and enter ihram from there for a new 'Umrah to make up for the defective one. The marriage contract must also be renewed. Additionally, you are required to offer a sacrificial animal: a sheep that is acceptable for the 'Id sacrifice, which is to be slaughtered in Makkah and distributed to the poor of the sacred precinct.
