Q1: A person from the people of Makkah works outside it and will return to his family in Makkah during the days of Hajj, but he wants to enter Makkah without entering the state of ihram; because he wants to visit his family and attend to his needs from them first, then enter the state of ihram from his home for Hajj , or go out to al-Tan'īm and enter the state of ihram for 'Umrah, then exit the state of ihram, then declare his intention for Hajj from his home. Is there anything required of him if he enters Makkah without entering the state of ihram, while he intends to enter the state of ihram for Hajj from his home, but only after attending to his needs from his family first?
A1 : Whoever arrives in Makkah passing through one of the miqat boundaries while intending Hajj or 'Umrah, it is obligatory for him to enter the state of ihram, whether he is from the people of Makkah or not;
due to the generality of the saying of the Prophet (peace and blessings be upon him) regarding the miqat boundaries:Sahih Muslim 1181a Therefore, it is not permissible for you to pass the miqat boundary while intending the rites of worship unless you are in the state of ihram. So, enter the state of ihram for 'Umrah. When you arrive in Makkah and perform the 'Umrah, you will exit the state of ihram and enjoy the company of your family, then enter the state of ihram for Hajj afterwards. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
