Fatwa number ( 17454 )
Q: I intended to perform 'Umrah from my place of residence in al-Bahah, and I boarded a bus heading to Makkah . We were about 20 individuals heading to Makkah with the intention of 'Umrah, and the rest, also about 20 individuals, were heading to Jeddah on the same bus. When we reached the mosque at the miqat, we asked the bus driver to take us to the miqat to enter ihram, but he continued on his way without stopping at the miqat. Some of the passengers supported him, arguing that they had families with them and were heading to Jeddah . We protested and complained that we wanted to enter ihram, and we knew that it is not permissible for us to pass the miqat, but the driver, who was Pakistani, said, “I have no information.” Some of the passengers encouraged him to keep driving, and we demanded that he stop so we could appeal to the police, but he continued heading to Makkah . We woke up in the morning having passed the miqat by a large distance, and he continued driving until he reached Makkah and took us into the Haram . He said, “This is the drop-off point for those who will stay in Makkah , and after that he will head to Jeddah . So we called the police for him, and all of us
the twenty individuals from the bus got off. While we were discussing the matter with the police, who were busy regulating traffic near the Haram , he took the bus and thus the individuals heading to Jeddah and quickly moved them away from us. We gathered some of us, and 13 individuals got into a car and returned to the miqat at Wadi Mahram and entered ihram, then we returned to Makkah and performed the 'Umrah. Is what we did valid and our 'Umrah complete, or do we owe something? Also, I have a colleague who performed Hajj last year, and I entrusted him with the need to slaughter the hady and gave him a sum of money for that, but due to the tightness of his time during that period, he left Makkah and went to his work without slaughtering the hady. Some people advised him that he must perform the slaughter in this year's Hajj, meaning that he conditions the place and time to clear his conscience. Is this what he must do, or should he slaughter it at the earliest opportunity to fulfill the trust placed in him? Please inform us, may Allah reward you, in this matter.
A : It was obligatory for you to enter ihram when you passed the miqat while you were traveling in the car, and it is not necessary to get off. Your passing the miqat without ihram was a mistake, but since you returned to this miqat and entered ihram from it, the requirement has been met and you owe nothing. As for the one who was entrusted with slaughtering the hady and the agent did not slaughter it, he erred in
that, and he must hasten to slaughter the hady in Makkah and distribute it there to make up for what was missed. If he is unable to go to Makkah , he should appoint someone to slaughter it in Makkah or return the amount to its owner and inform her that he did not slaughter it so she can appoint someone to slaughter it there. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
