Q: We are forwarding to you the inquiry submitted by (A.Y.S.) regarding the amounts paid by the tribe or sub-tribe into a fund, fifty riyals from each person, for the purpose of life's unforeseen events, namely: accidents
and the blood money resulting from deaths among them. Therefore, we ask Allah, then you, to issue a ruling on the zakah of such reserved funds, and also to clarify the ruling on compelling the tribe to pay the blood money, even though what is mentioned in the Shari'ah is that the blood money is the responsibility of the 'aqilah (close male relatives). May Allah bless your efforts and prolong your life in His obedience.

A: There is no zakah on funds collected for the purpose of assisting the needy; because they do not have an owner, and because they are spent on what zakah is spent on, namely assisting the needy and those in debt. It is not permissible to compel anyone to pay a monthly or annual amount to the association; rather, it is on a voluntary basis; based on the saying of the Prophet (peace and blessings be upon him):
The wealth of a Muslim man is not lawful except by the willing consent of his soulلا يحل مال امرئ مسلم إلا بطيبة من نفسه
Sunan ad-Daraqutni 13:78
. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
