The Marriage of a Muslim Woman to a Non-Muslim
Machine translationRead the Arabic original
Q: One of my friends (a Hadrami from Yemen ) lives in Indonesia and wishes to marry a non-Muslim man of another nationality,
but her family opposes her and says that this marriage is forbidden. What is the ruling on this?
A: It is not permissible for the guardian of a Muslim woman to marry his ward to a disbeliever under any circumstances. The Muslim community has reached consensus that a disbeliever does not have the right to have sexual relations with a believing woman in any way, due to the insult this causes to Islam, and because of the saying of Allah the Exalted:[Al-Baqarah 2:221]. Also, marriage is the strongest cause of loyalty, and Allah the Sublime has forbidden us from showing loyalty to disbelievers and remaining among them. Allah the Exalted said: [Al-Mumtahanah 60:10]. If it is forbidden for a woman to remain with her husband after she embraces Islam, then initiating her marriage to a polytheist is forbidden a fortiori.

A: It is not permissible for the guardian of a Muslim woman to marry his ward to a disbeliever under any circumstances. The Muslim community has reached consensus that a disbeliever does not have the right to have sexual relations with a believing woman in any way, due to the insult this causes to Islam, and because of the saying of Allah the Exalted:
And do not marry polytheistic men [to your women] until they believe. And a believing slave is better than a polytheist, even though he might please you. Those invite [you] to the Fire, but Allah invites to Paradise and to forgiveness, by His permission
O you who have believed, when the believing women come to you as emigrants, examine them. Allah is most knowing as to their faith. And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for them
