Q: My father (may Allah have mercy on him) bought two cars for two of my brothers, one for each. He has since passed away (may Allah have mercy on him). I have heard from some scholars that this constitutes a failure to be just, because giving them these cars is not a matter of financial maintenance. The Prophet (peace and blessings be upon him) commanded justice among children, and their need could have been met by keeping the cars in the father's ownership while they used them. Therefore, desiring to clear my father's conscience, I would like your ruling on what should be done? May Allah guide you and keep your steps steady.
A: It is obligatory to be just in gifts to children, based on the saying of the Prophet (peace and blessings be upon him) in the hadith of al-Nu'man ibn Bashir :
Be afraid of Allah, and be just to your children.اتقوا الله واعدلوا بين أولادكم
Sahih al-Bukhari 2587
It is agreed upon by al-Bukhari and Muslim. Since your father's gift to your two brothers was accepted and your father died before he could take it back, the gift is binding and remains with them, and the other heirs have no right to claim it back from them. You should all pray for your father and seek forgiveness for him, for that is part of being dutiful to him after his death.
