Q4: Some market traders deceive pilgrims into buying small sheep that have not reached the required age for hady or udhiyah to be slaughtered as expiation or hady. Does this suffice given the circumstances described?
A4: It does not suffice for the hady of tamattu' or qiran, nor for expiation or udhiyah, to use a camel, cow, or sheep that is young and has not reached the age required for hady and udhiyah. That is: it must be a jadh' (one-year-old) from sheep, which is one that has completed six months; or a thani (two-year-old) from goats, which is one that has completed one year; or a thani from cows, which is one that has completed two years; or a thani from camels, which is one that has completed five years. Ibn 'Abd al-Barr (may Allah have mercy on him) said: "I am not aware of any disagreement that a jadh' from goats or from anything other than sheep is not permissible, and only a thani or older is permissible from all of that, and a jadh' from sheep is permissible according to the established Sunnah."
