Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet. After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what
was sent to His Eminence the Grand Mufti from His Excellency the Deputy Minister of Labor and Social Affairs, Awad ibn Baniyah al-Radadi, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (11124) and date 5/12/1424 AH. The inquirer asked a question, the text of which is as follows: We inform Your Eminity that among the disabled persons covered by the care of this ministry are individuals who reside in residential rehabilitation institutions and centers, where the state provides them with all their living needs. The reason for their admission to these centers is the inability of their families to care for them in their homes due to the severity of the disabilities they suffer from. Some suffer from severe physical disabilities, some from severe mental retardation, and others from multiple disabilities. All these disabilities render them unable to manage their life affairs by themselves, while their families may be well-off and have sufficient financial means. Our question to Your Eminity is as follows: Is zakat al-fitr waived for these disabled persons on the basis that they do not have the money to pay it, or should their families continue to pay the zakat on their behalf even after their admission to the centers, or should the state take charge of paying the zakat on their behalf as part of the care it provides them? The question ends here.
I hope Your Eminity will graciously look into this matter and issue a fatwa regarding it so that we can act in accordance with it. May Allah guide you and protect you, and please accept my best greetings and respect.

After studying the inquiry, the Committee answered: Zakat al-fitr is obligatory in the property of the disabled person if he has property. If he has no property, it is obligatory upon his guardian. If his guardian is unable to pay it on his behalf, it is waived.
