Fatwa number ( 14055 )
Q: A man proposed to a girl whom her mother did not approve of. After winning over her feelings, she agreed to please her son. However, after the marriage, problems began between the wife and the husband's mother. This wife mistreated the mother greatly, sometimes with insults and sometimes with beating. So the husband promised his mother that he would divorce his wife once his financial situation improved. At the time he made this promise to his mother, his wife had already given birth to a daughter. Later, the mother passed away, and the wife had given birth to two more children, so he had four children from her. Now his financial circumstances have improved. Does he have to fulfill the promise he made to his mother, or should he keep her out of mercy and compassion for the children?
A: If the wife is satisfactory in her religion and character, and she has repented from the previous mistreatment of your mother, then there is no harm in continuing with her, provided you expiate the oath you made to yourself. The expiation is: feeding ten poor people, or clothing them, or freeing a believing slave. If you cannot find any of these, then fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
