Dutifulness to Your Parents, Even If They Are Disbelievers

Fatwa No. ( 3066 )
Q: I live with my parents in our village, which is far from, not near, Tamal . My parents do not believe in the religion of Islam. A scholar from Tamal visited us and gave us a great sermon. When I heard this sermon, I embraced Islam while I was seven years old. I then sought knowledge from that scholar until he passed away. My father asked me to leave this Islamic religion, but I refused.
He began to harass and torment me with the harshest torment, until he nearly killed me. So I left him for the sake of my religion and came to Tamal. Is it obligatory for me to be dutiful to this father? If he dies, should I perform the funeral prayer for him? Is it possible for me to leave my religion out of love for my father? This is the affliction that has befallen me until I nearly killed myself. I ask Allah, Glorified and Exalted is He, to help you and to grant you your objectives, for He is near and hears the supplication. And may peace and the mercy of Allah and His blessings be upon you.
A: If the situation is as you described, praise Allah for guiding you to Islam, and stand firm upon it, learn its rulings, and follow the path of truth. Do not obey your father in what he calls you to, whether it is disbelief or disobedience to Allah, for there is no obedience to a created being in disobedience to the Creator. Pleasing Allah by following Islam is more deserving than pleasing your parents by following what they are upon of disbelief and misguidance. Nevertheless, you must be dutiful to your parents even if they are disbelievers, and you must treat them with kindness in this world, by providing for their expenses, clothing them, being kind to them, speaking gently to them, being gentle with them, and calling them to Islam with wisdom and good instruction, guiding them to the evidence of the truth, so that perhaps Allah will guide them to Islam. If one of them refuses to submit to Islam, there is no harm in your taking charge of his burial and doing what is required for that, without praying over him or making supplication for him, and without participating with the people of his religion in their innovations that they commit in following their funerals and burying their dead, and the sins that follow that.
Allah the Exalted said:[Luqman 31:14-15] And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

Allah the Exalted said:
(14) And We have enjoined upon man [care] for his parents. His mother carried him, [increasing her] in weakness upon weakness, and his weaning is in two years. Be grateful to Me and to your parents; to Me is the [final] destination. (15) But if they endeavor to make you associate with Me that of which you have no knowledge, do not obey them but accompany them in [this] world with appropriate kindness and follow the way of those who turn back to Me [in repentance]. Then to Me will be your return, and I will inform you about what you used to do.
