Fatwa No. ( 14902 )
Q: If a person is breastfed by a woman five times or more, are the brothers of this person prohibited from marrying the daughters of the woman who breastfed their brother, and vice versa, meaning: the children of the woman, whether from this man who provided the milk or from another man who had previously married her before the husband who provided the milk, and the brothers of the breastfed child, whether from the father with another woman or from the mother with another husband, whether older or younger? I ask for a detailed explanation of this breastfeeding that is prohibited and that which is not prohibited.
A: It is a condition for breastfeeding that is prohibited that it occur within the first two years of the child's life, and that it be five breastfeedings or more. The description of a breastfeeding is that the child holds the breast and sucks milk, and if he leaves it for himself or to move
to another breast, it is counted as one breastfeeding, and so on until five breastfeedings are completed. If it is less, even by one breastfeeding, it does not create prohibition; this is based on His saying, the Exalted, regarding those who are prohibited:
your [milk] mothers who nursed you, your sisters through nursingوَأُمَّهَاتُكُمُ اللاتِي أَرْضَعْنَكُمْ وَأَخَوَاتُكُمْ مِنَ الرَّضَاعَةِ
[An-Nisa 4:23]
and His saying, peace and blessings be upon him, in the hadith agreed upon by al-Bukhari and Muslim:
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.يحرم مـن الرضاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
, and Muslim narrated from A'ishah (may Allah be pleased with her) that she said:
Ten known breastfeedings were revealed in the Qur'an that create prohibition, then five of them were abrogated, and it became: (Five known breastfeedings create prohibition). The Messenger of Allah, peace and blessings be upon him, passed away while the matter was still as it was.
. If a person is breastfed by a woman and his breastfeeding is as described above, then he becomes her son and the son of her husband through breastfeeding, and a brother to all her sons and daughters, whether from before him or after him, and a brother to all her sons and daughters from her other husbands; because he is their mother's son through breastfeeding. Likewise, he is a brother to all the sons and daughters of his husband who provided the milk from his other wives; because he is their father's son through breastfeeding. As for the brothers of the person who was breastfed, they do not enter into the breastfeeding relationship with him; rather, the ruling applies only to the one who was breastfed, because he is the one who entered into the relationship with those who were breastfed.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
