Q 3: What is the ruling on meat found in markets that was slaughtered abroad , is it permissible to eat it or not?
A 3: If the one who slaughters the livestock or birds is not a People of the Book; such as the disbelievers of Russia and Bulgaria and those similar to them in atheism and rejection of religions - then their slaughter is not eaten, whether the name of Allah is mentioned over it or not; because the original ruling is that only the slaughter of Muslims is lawful, and the slaughter of the People of the Book was excepted by explicit text, and if the one who slaughtered it is from the People of the Book ( the Jews or the Christians ) then if their slaughter of it is by cutting its neck or slaughtering it in its throat while it is alive and the name of Allah is mentioned over it, it is eaten by consensus; due to the saying of Allah the Exalted:
and the food of those who were given the Scripture is lawful for youوَطَعَامُ الَّذِينَ أُوتُوا الْكِتَابَ حِلٌّ لَكُمْ
[Al-Ma'idah 5:5]
And if the name of Allah is not
mentioned over it intentionally and no other name is mentioned, then there is scholarly disagreement regarding the permissibility of eating it, and if the name of other than Allah is mentioned over it, it is not eaten, and it is carrion; due to the saying of Allah the Exalted:
And do not eat of that upon which the name of Allah has not been mentioned, for indeed, it is grave disobedience.وَلاَ تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ وَإِنَّهُ لَفِسْقٌ
[Al-An'am 6:121]
And if it is struck on the head with a gun or an electric current is applied to it, for example, and it dies from that, then it is a strangled animal, even if its neck is cut after that, and Allah has forbidden it in His saying:
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blowحُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالدَّمُ وَلَحْمُ الْخِنْـزِيرِ وَمَا أُهِلَّ لِغَيْرِ اللَّهِ بِهِ وَالْمُنْخَنِقَةُ وَالْمَوْقُوذَةُ
[Al-Ma'idah 5:3]
Except if it is caught alive after being struck on the head and slaughtered, then it is eaten; due to the saying of Allah at the end of this verse:
or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death]وَالْمَوْقُوذَةُ وَالْمُتَرَدِّيَةُ وَالنَّطِيحَةُ وَمَا أَكَلَ السَّبُعُ إِلا مَا ذَكَّيْتُمْ
[Al-Ma'idah 5:3]
, so the Exalted excepted from the forbidden things what was slaughtered of them if it was caught alive; because slaughter has no effect on a dead animal. As for what is strangled until it dies or an electric current is applied to it until it dies, it is not eaten by consensus, even if the name of Allah is mentioned over it when it is strangled or the electricity is applied to it or when it is eaten. As for the saying of the Messenger of Allah (peace and blessings be upon him):
Mention the name of Allah and eatسموا الله وكلوا
, that was only regarding the slaughter of people who had embraced Islam, but they were recent from the pre-Islamic age of ignorance, and it was not known whether they had mentioned the name of Allah over it or not? So he ordered the Muslims who doubted the naming of these people over their slaughter - to do what is required of them, which is to mention the name of Allah when eating, and to assume that these slaughterers did what is customary among Muslims, which is mentioning the name of Allah when slaughtering. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
