Fatwa number ( 1253 )
Q: The substance of the question is that the questioner’s father gave him to his aunt seven days after his birth for her to breastfeed and raise him. His aunt did so, and his father died two years after his birth, leaving behind a sister who is younger than the questioner. He claimed that his mother killed her when she married a man after his father, a man who did not want this girl to live with him in his house. He mentioned that his mother has eight children from this man, and that when he goes to visit her—despite the distance—his husband prevents him from seeing her. He stated that he has become the father of five children, that he is poor, and he asks what is obligatory upon him? What is obligatory upon his mother regarding maintaining ties? Is there a sin upon him or her for not maintaining ties? He requests guidance.
A: It is obligatory for you to be dutiful to your mother and to treat her well to the extent of your ability, even if she did not breastfeed you or raise you; for Allah the Exalted said:[An-Nisa 4:36] And He the Exalted said: [Al-Isra 17:23] And He the Exalted said:
[Luqman 31:15] And for what was narrated by al-Bukhari and Muslim from Abu Hurayrah . It is forbidden for you to suspect her, to have a bad opinion of her, or to speak about her without knowledge. Allah the Exalted said: [Al-Hujurat 49:12] And He the Exalted said: [Al-Isra 17:36] If you go to visit her, or if you intend to be dutiful to her and treat her well, but she refuses, or her husband prevents her, or prevents you from contacting her or sending anything to her, then you have done what is required of you, and there is no sin upon you; for Allah the Exalted said: [Al-Baqarah 2:286] And beware of cutting off ties with her or mistreating her; rather, respond to her mistreatment with kindness; for the Messenger of Allah (peace and blessings be upon him) said: Sahih al-Bukhari 6273
The hadith, and his saying:Sahih al-Bukhari 2408 , and his saying: Jami` at-Tirmidhi 1909Sahih (Darussalam) , and his saying: Sahih al-Bukhari 5991 If you are poor, it is sufficient that you visit her and greet her with a good greeting, with a cheerful face and joy. She should show compassion to you and enable you to maintain ties with her to the extent of her ability. If she does not do so, do not mistreat her, but rather treat her well. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
