Q: I quarreled with my wife and lost my temper under the influence of the dispute, and I said to her: “You are divorced.” I had previously divorced her twice before this, also under the influence of severe anger. His Eminence the President wrote to His Eminence the Shaykh: Sulayman ibn 'Ali ibn Dukhayl , the President of the High Court in al-Ta'if, to ask both the husband and the wife (M.) and their guardian about the nature of the previous and subsequent divorces, the reasons for the last divorce, and about his anger: was it severe and altered his feelings, or was it ordinary? The honorable President of the court answered that the wife (M. 'A. H. Y.) and (S. Y. S. Y.) appeared before him, and after they were identified by (M. F. M. Y.), who holds passport number (2826 \ 17) issued in
19 \ 2 \ 1975 CE, from Jeddah, and (M. 'A. H. Y.), who holds passport number (12669 \ 71 CE) issued in Jeddah, each of (S. Y. S. Y.) and the aforementioned (M.) was asked about what happened between them. (S.) stated that (M.), my wife, had previously been divorced by me once and then I took her back, then I divorced her a second time and then took her back, then I had a dispute with her and became severely angry, as I was ill, and I divorced her a third time, saying to her: “You are divorced.” I wish to take her back if that is permissible. Then (M.) stated: My aforementioned husband divorced me and then took me back, then divorced me and then took me back, then in the last instance I was angry with him because he hit me, and he was ill and became severely angry and said: “You are divorced.” This is the truth, and I have no objection to taking him back.

A: Since (S. Y. S. Y.) divorced his wife (M. 'A. H. Y.) once and then took her back, then divorced her once and then took her back, then divorced her a third time, she is not lawful for him until she marries another husband in a marriage that is valid according to the Shari'ah, and he has intercourse with her in that marriage. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
