Q: My husband (M. I. H.) divorced me by saying: “You are divorced,” and he boycotted me for more than three months. Then he came back and took me back himself without a new contract or a new bridal gift. I was not pregnant at the time of the divorce, and I have not been pregnant until now. The number of menstrual cycles was three complete cycles, and four periods of purity. Then he came back and divorced me a second time by saying: “You are divorced,” and he took me back after twenty days. Then he divorced me a final time by saying: “You are divorced.” Is it permissible for me to return to his protection, and how is that done? The following phrase appeared in the inquiry paper: “The number of menstrual cycles was three complete cycles and four periods of purity, then he took me back after that.”
A: If the matter is as the questioner described, that her husband divorced her
by saying: “You are divorced,” and she was not pregnant, then he took her back after she had menstruated three times and four periods of purity had passed for her—his taking her back is not valid and is not considered in the Shari'ah. Therefore, his enjoyment of her after this taking back is enjoyment under a doubtful marriage. If they were ignorant of the matters of divorce and taking back, they are both negligent in leaving off the asking of scholars before proceeding with the taking back. As for the second and third divorces, they are void; because the questioner is a stranger to the one who was her husband, by her exiting the waiting period of the first divorce, so his second and third divorces did not find a place. And if each of them desires a valid marital life, it is obligatory for that to be a new marriage contract with a new bridal gift and her consent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
