Q: If I currently have a wife who had previously been married to another man before me, and this man has a daughter from another woman, is it permissible for me to marry this daughter and my wife, whom her father had previously married before me?
A: It is permissible for you to combine your wife, who previously married
a man, with the daughter of that man from another woman, not this wife; because Allah the Exalted did not mention the prohibition of combining them in the specification of those who are forbidden, and the Prophet (peace and blessings be upon him) did not mention it either. And Allah the Exalted said after mentioning those who are forbidden:[An-Nisa 4:24] , so combining them falls under the generality of this phrase, because the prohibition of combining was due to the severance of the close kinship between those who are related by affinity, and there is no close kinship between these two. And Abdullah ibn Ja'far and Safwan ibn Umayyah did something like that, and it is not known that anyone criticized them for it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
