Q: Is it permissible for a man to marry a woman whose husband has died, and the daughter of that deceased man from another woman whom he had previously divorced? Knowing that there is no kinship or milk kinship between this daughter and her father’s wife.
A: Yes, it is permissible for a man to marry a woman who was the wife of a man
and her daughter from another woman, according to the opinion of the majority of scholars, which is the correct view. This is because the original ruling is permissibility, and no evidence from the Book or the Sunnah has been established to prohibit marrying both of them. Indeed, Allah has mentioned those women whose marriage is forbidden, and He did not include in the list of forbidden women the case of marrying a woman and the daughter of her husband from another woman. Therefore, marrying both of them falls under the general meaning of the saying of the Exalted:
And lawful to you are [all others] beyond theseوَأُحِلَّ لَكُمْ مَا وَرَاءَ ذَلِكُمْ
[An-Nisa 4:24]
. Also, the prohibition of marrying both is to keep people away from and protect them against the causes of severing the close family ties between relatives, and there is no kinship or milk kinship between these two. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
