Q: After much debate in one of the gatherings of the Bedouin regarding a man who saved a woman from drowning in a well, it was said that the rescuer proposed to the aforementioned woman after the rescue. When they were present at the mu'adhdhin, they informed the mu'adhdhin that this suitor had saved his fiancée from drowning. The mu'adhdhin told them: If he had previously saved her, she is not lawful for him as a wife, knowing that Allah, Glorified and Exalted is He, has clarified what is lawful and what is forbidden in Surat al-Nisa. Is there a disagreement among the scholars regarding the mu'adhdhin's statement and what is mentioned in the noble Surah? I ask Allah, then your Eminence, to guide us to the truth. I also inform your Eminence that I engaged in much debate with the person related to the aforementioned news, telling them that I know only what came in the Book of Allah in Surat al-Nisa. Please issue a ruling, may Allah have mercy on you.
A: If the matter is as described, it is permissible for him to marry her, and his saving her does not prevent him from marrying her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
