Q: What is the ruling on the inheritance of a child of zina if his lineage is established from the one who fathered him? Does he inherit from him or not?
A: The correct opinion among the scholars is that the child’s lineage is not established with the man who had intercourse with the woman unless the intercourse was based on a valid marriage, a defective marriage, a marriage of doubt, ownership of a slave woman, or a doubt regarding ownership of a slave woman. In that case, his lineage is established with the man, and they inherit from each other. However, if the intercourse was zina, the child is not attributed to the fornicator, and his lineage is not established with him; consequently, he does not inherit from him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
