The Inheritance of the One Who Caused the Killing

Machine translationRead the Arabic original
Fatwa No. ( 5263 )
Q: I have a father who is seventy years old. One day, I took him to Najran, and he was at the right door. When the strap fell from his head to the ground, he said, "Stop." When it fell
his strap, and I was driving at seventy, I wanted to stop. He said to me, "I will get out." As he was closing the door and finishing his words to me, he jumped out of the door. There were two passengers between me and him. I did not notice the door opening until he had fallen onto the asphalt and passed away to the mercy of Allah (Glorified and Exalted is He). After his death, I went to some students of knowledge, and they told me that the heirs of my father cannot decide on the matter because I was the driver of my father when he jumped out of the car door, and out of fear that I might be among the three categories prohibited from inheritance. The Najran police handled the incident, and the public right is established against me at twenty-five percent (25%) and fasting for two consecutive months. The rest of the heirs have waived their rights against me. Therefore, I ask your Eminence to issue a written fatwa: Do I deserve anything from my father's estate or not?

A: If the matter is as you described, we do not see that you are deprived of the inheritance, and there is no expiation upon you; because it was he who caused his own death. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
