Q: Ifmy aunt, my wife’s mother, gaveus eight hundred riyals (800) in 1398 AH, and I was in need of it at that time, and she said: “Use this money to expand, and if I die, do not forget me from it.” In 1401 AH, Allah decreed her death and she passed away to the mercy of Allah, and the money is still with me now. She intended by this something like a bequest. I told her: “Take it back and I will be aware of it,” and she said: “Do not forget me from it after my death.” Today, I ask your eminence to issue a ruling on the procedure to follow in this matter, knowing that she has heirs and children after her, and she did not clarify anything other than what I mentioned.
A: If the situation is as you described, that she performed Hajj multiple times, that she had a great deal of money besides the eight hundred riyals, and that she gave you this amount (800 riyals) and refused to accept it back from you until she died, while saying: “Do not forget me from it after death,” then put it into trade or something that yields profit, if possible, so that you may give charity on her behalf from the profit. If that is not possible or is difficult
for you, then give charity from it on her behalf until it is exhausted. If any of her heirs disputes her bequest of this amount, the resolution of that lies with the court. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
