The second question of Fatwa No. ( 7631 )
Q2: If a person sends money to his father to keep it for him as a trust until he returns to his country, or authorizes the father to invest it for him (the son), and then the father buys a piece of land for himself and registers it in his own name, is the son entitled to ask his father to register the land in his name (the son's name), or to demand the money he previously sent him, or what should he do in this case?
A2: If the situation is as you described, you may claim your right from your father in a good manner, unless he needs the proceeds of what you gave him. If he responds to you, praise be to Allah. If he needs it or its proceeds for his own expenses and those of his dependents, you may not demand it from him; based on the saying of the Prophet (peace and blessings be upon him): when a man said to him: "My father has seized my wealth," and his saying (peace and blessings be upon him): Sunan Ibn Majah 2290Sahih (Darussalam) .
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
