Q6: Muslims purchased houses and turned them into mosques. Do they have the ruling of mosques? And when the Muslims move from one neighborhood to another, they sell
these mosques and buy new houses, and sometimes they divide the amount among themselves. What is the ruling?
A6: It is permissible for Muslims to purchase houses and develop them as mosques, and they have the ruling of mosques regarding respect and performing the prescribed acts of worship in them, and maintaining them with the remembrance of Allah in the manner prescribed by the Shari'ah. It is not permissible to sell them and replace them with other mosques except out of dire necessity, such as if they are abandoned because the people around them have moved away. If they move to another neighborhood and there is no group of Muslims around them, it is permissible to sell them and purchase other lands or houses to develop them as mosques in the place to which they moved, using their price; in order to preserve the public benefit. It is not permissible to distribute their price among those who established them, nor to the poor; because they are an endowment, so no benefit may be derived from their price except in purchasing or constructing something similar to them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
