Fatwa number ( 11930 )
Q: The questioner requested a ruling on reclaiming land that he donated for the construction of a mosque in the village, even by purchasing it, because the Waqf authority no longer needs this donated land.
A: It is not permissible for you to return to the land that you endowed, even in exchange for a price; because you have dedicated it to Allah, and it is only sold to someone other than the endower. It is established that
That 'Umar (may Allah be pleased with him) mounted a horse of his in the cause of Allah, which the Messenger of Allah (peace and blessings be upon him) had given him to carry a man on. 'Umar informed him that he had endowed it and was selling it, so the Messenger of Allah (peace and blessings be upon him) asked to buy it. He said: Do not buy it, and do not return to your charity.
narrated by al-Bukhari . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
