Q: I, my family, my friend, and his family entered ihram from the miqat, then an incident occurred and we returned as a result, and we did not complete the 'Umrah. We did not make the condition at the time of intention: “If I am prevented, then my place of exit is where I am prevented.” We forgot it. What is obligatory upon us because of exiting ihram and not completing the 'Umrah? And is it permissible to slaughter the sacrificial animal at my place of residence if a sacrificial animal is due upon us? Those accompanying me are: my wife, an adult son, an adult daughter, a daughter aged fourteen, a son aged eleven, and five children who have not reached the age of ten. Those accompanying my friend are: he, his wife, and four children who have not reached the age of five. May Allah guide you to good deeds and the best of deeds.
A: It is obligatory for all of you to return and perform the 'Umrah with sincere repentance. Whoever among you engaged in sexual intercourse must slaughter a sacrificial animal in Makkah for the poor, and he must make up the 'Umrah; because the first one became invalid due to that; so it is obligatory for him to complete it along with making it up. The ihram of the one who engaged in intercourse for the second time is from
the miqat from which he entered ihram for the first time. As for what occurred regarding wearing sewn clothing, using perfume, and the like, if it was due to ignorance or forgetfulness, then there is nothing in it. But if it was done intentionally with knowledge of the ruling of the Shari'ah, then there is an expiation, which is feeding six poor people, for each poor person half a sa' of the staple food of the land, or fasting three days, or slaughtering a sheep for each prohibited act of wearing [sewn clothing], covering the head, using perfume, clipping nails, shaving the pubic hair, trimming the beard, or plucking the armpit hair, along with sincere repentance from that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
