Q: I inherited an estate from my father, which he had inherited from my grandfather. My grandfather had bequeathed to my father that this estate contains seven pilgrimage debts. Then my father bequeathed to me that this estate contains seven pilgrimage debts. My father said that he does not know who the owners of the debts are, what their names are, or whether they are male or female. The estate now is not worth a single pilgrimage. I ask you to inform me about how to discharge them, and whether it is obligatory upon me by the Shari'ah to discharge these pilgrimages from my share if this estate does not suffice for the pilgrimages, and how do I perform the pilgrimage on behalf of people whose names I do not know, except that there are seven pilgrimages in this estate?
A: We see that you should collect the produce that the owner of the land is entitled to, and perform the pilgrimage from it whenever enough accumulates to pay for a pilgrimage on behalf of one of the seven,
until seven pilgrimages have been performed from its produce. After that, the land becomes free for the heirs of your grandfather and your father according to the Islamic law of inheritance. This is done with the intention of performing the pilgrimage on behalf of the people your grandfather intended. It is not obligatory upon you to perform the pilgrimage on their behalf with your own person or your own money; rather, that is obligatory from the produce of the land. If you perform the pilgrimage on their behalf as a voluntary act from you, may Allah reward you with good. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
