Q1: I have heard that it is not permissible to give charity, or rather to take charity, for the family of the Prophet (peace and blessings be upon him), namely the Banu Hashim , and the Banu Muttalib (may Allah be pleased with them). Is what I heard correct? And if the answer is yes, what are the matters related to being from the family of the Prophet (peace and blessings be upon him)? I mean, are there any obligations specific to them that do not apply to the rest of the Muslim families? A family whose lineage traces back to 'Aqil (may Allah be pleased with him) has a relative close to the general Muslims, who is the mother of their mother, and she receives from the zakah funds. By virtue of this kinship, she sends a gift from this money to the children of this family. Is it permissible for them to accept the gift?
A1: First: It is not permissible to give zakah to the aforementioned people; because of the evidence that has come regarding this which forbids it for them, among which is what the Imam Muslim (may Allah have mercy on him) narrated from 'Abd al-Muttalib ibn Rabi'ah ibn al-Harith (may Allah be pleased with him): he said
The Messenger of Allah (peace and blessings be upon him) said:
It does not become the family of Muhammad (to accept) sadaqat for they are the impurities of people.إن الصدقة لا تنبغي لآل محمد، إنما هي أوساخ الناس

, and in another narration:
it is not permissible for Muhammad or for the family of Muhammadإنها لا تحل لمحمد ولا لآل محمد
Sunan an-Nasa'i 2609Sahih (Darussalam)
. Second: If one who is not from the family of the Prophet (peace and blessings be upon him) is given from the zakah funds and then gifts some of it to one of the family, it is permissible for the one from the family to whom it was gifted to benefit from it. Umm 'Atiyyah (may Allah be pleased with her) said:
The Messenger of Allah (peace and blessings be upon him) sent me a sheep from the charity, so I sent some of it to 'A'ishah. When the Messenger of Allah (peace and blessings be upon him) came, he said: "Do you have anything?" She said: "No, except that Nasaibah sent us some of the sheep that you sent to her." He said: "It has reached its proper place"بَعث إليّ رسول الله صلى الله عليه وسلم بشاة من الصدقة، فبعثت إلى عائشة منها بشيء، فلما جاء رسول الله صلى الله عليه وسلم قال: هل عندكم من شيء؟، فقالت: لا، إلا أن نسيبة بعثت إلينا من الشاة التي بعثتم بها إليها، فقال: إنها قد بلغت محلها
Agreed upon by al-Bukhari and Muslim, and the wording is that of Muslim . And in the hadith of Barirah :
It is an object of charity for Barira, and it is a present for us.أنها عليها صدقة ولنا هدية
