The first question of Fatwa number ( 5232 )
Q1: The Messenger of Allah (peace and blessings be upon him) said:Sunan an-Nasa'i 921Sahih (Darussalam) And the Messenger of Allah (peace and blessings be upon him) said: Sunan ad-Daraqutni 3:313 And He, Exalted is His Majesty, said: [Al-A'raf 7:204] And the Messenger of Allah (peace and blessings be upon him) said: Jami` at-Tirmidhi 247Sahih (Darussalam) O Shaykh, we seek your guidance regarding the reconciliation of these pieces of evidence; because some people say: If it is a prayer where the imam recites aloud, after the followers say the ameen, it is permissible for them to recite Surat al-Fatihah, even if the imam is reciting aloud. Is this permissible or not? May Allah guide you. And if it is permissible for the imam to remain silent after the followers say the ameen so that they can recite Surat al-Fatihah, what is the significance of their saying the ameen? We see in some books that the followers' saying the ameen on the imam's recitation of Surat al-Fatihah takes the place of their reciting it. May Allah guide you?
A1: The correct opinion among the scholars is that it is obligatory to recite al-Fatihah in prayer for the one praying alone, the imam, and the follower in both the loud and quiet prayers; because of the authenticity of the evidence pointing to this and its specificity. As for the saying of Allah the Exalted:[Al-A'raf 7:204] it is general, and likewise the saying of the Prophet (peace and blessings be upon him): is general regarding al-Fatihah and others. They are specified by the hadith: Jami` at-Tirmidhi 247Sahih (Darussalam) in order to reconcile the established evidence. As for the hadith: Sunan ad-Daraqutni 3:309 it is weak, and it is not correct to say that the followers' saying the ameen on the imam's recitation of al-Fatihah takes the place of their reciting al-Fatihah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
Q1: The Messenger of Allah (peace and blessings be upon him) said:
The Imam is appointed to be followed, so when he says the takbir, say the takbir, and when he recites, be silent
إنما جعل الإمام ليؤتم به، فإذا كبر فكبروا، وإذا قرأ فأنصتواWhoever has an imam, then his recitation is for him
من كان له إمام فقراءته له قراءةSo when the Qur'an is recited, then listen to it and pay attention that you may receive mercy.
وَإِذَا قُرِئَ الْقُرْآنُ فَاسْتَمِعُوا لَهُ وَأَنْصِتُوا لَعَلَّكُمْ تُرْحَمُونَThere is no Salat for the one who does not recite Fatihatil-Kitab.
