Q: We are Bedouins in the desert, and the water is fifty kilometers away from us. We bring water for our families in cars, and we water the camels and sheep. Is wudu' and ghusl from janabah obligatory upon us? Some houses have ten people, and some have more than that. Is tayammum permissible for us? We ask you to inform us.
A: Praise be to Allah alone, and peace and blessings be upon His Messenger, his family,
and his Companions... After that: Allah has made wudu' and ghusl obligatory when water is present, and He has made tayammum obligatory when water is absent, or when its use is prevented by illness or the like. He the Exalted said:
O you who have believed, when you rise to [perform] prayer, wash your faces and your forearms to the elbows and wipe over your heads and wash your feet to the ankles. And if you are in a state of janabah, then purify yourselves. But if you are ill or on a journey or one of you comes from the place of relieving himself or you have contacted women and do not find water, then seek clean earth and wipe over your faces and hands with itيَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا قُمْتُمْ إِلَى الصَّلاَةِ فَاغْسِلُوا وُجُوهَكُمْ وَأَيْدِيَكُمْ إِلَى الْمَرَافِقِ وَامْسَحُوا بِرُءُوسِكُمْ وَأَرْجُلَكُمْ إِلَى الْكَعْبَيْنِ وَإِنْ كُنْتُمْ جُنُبًا فَاطَّهَّرُوا وَإِنْ كُنْتُمْ مَرْضَى أَوْ عَلَى سَفَرٍ أَوْ جَاءَ أَحَدٌ مِنْكُمْ مِنَ الْغَائِطِ أَوْ لامَسْتُمُ النِّسَاءَ فَلَمْ تَجِدُوا مَاءً فَتَيَمَّمُوا صَعِيدًا طَيِّبًا فَامْسَحُوا بِوُجُوهِكُمْ وَأَيْدِيكُمْ مِنْهُ
[Al-Ma'idah 5:6]
. Since the questioner mentioned that they bring water to water the camels and sheep, they are in possession of water; therefore, wudu' and ghusl are obligatory upon them. The fact that you are Bedouins in the desert and that the water is fifty kilometers away from you is not an excuse that permits tayammum, as long as you bring water in cars for the camels and sheep. And Allah knows best. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
